These terms and conditions apply to any and all bookings formed between ASPIRE International Youth Music Festival or its parent company (Student Horizons Pty Ltd) (“ASPIRE”, “We”, “Us” or “Our”) and you. Please ensure you have read and understand these terms and conditions prior to confirming your booking with us.

1. YOUR CONTRACT

(a) By entering this site, you agree to and accept these terms of conditions, festival rules and our privacy statement.

(b) When you make a booking to enter the ASPIRE International Youth Music Festival, you guarantee that you have the authority to accept, and do accept on behalf of your party, these booking terms and conditions.

(c) A contract will exist as soon as we issue you with our written email confirmation of acceptance and you accept this confirmation via our online information portal.

(d) Through confirming your attendance, our system will automatically generate a deposit invoice, requesting a non-refundable deposit for every participating student.

(e) This contract is made on these terms and conditions which are governed and construed in accordance with the laws of the State of Queensland and you must submit to the non-exclusive jurisdiction of the courts of that State in respect of any dispute of whatsoever nature arising under these terms and conditions or its implementation or enforcement.

(f) Once you have received your confirmation email letter, it is your responsibility to check that the information and booking details as stated, are correct.

(g) Amendments can be made online using your access details which are automatically provided to you on your confirmation email letter. Changes to student numbers will be reflected in the final payment invoice therefore it is crucial your ‘total’ student numbers, regardless of how many ensembles they are representing, is as accurate as possible to avoid any dramatic adjustments to your final invoice amount.

2. CHANGING & UPDATING OF DETAILS

(a) You must update your application promptly if there is a change to any information that you have provided us, with particular emphasis to the total number of students participating in the festival as this automatically reflects changes to invoicing.

(b) All changes must be made through the information portal and must be completed in full within 24 hours prior to the final invoice process date of 1 May 2017.

(c) ASPIRE Information portal closes for edits 5pm 30 April 2017.

(d) ASPIRE will not be held responsible for any incorrect information entered on the information portal.

(e) Information entered on the portal prior to final payment issue date 1 May 2017, is considered final and will be used for publishing in the festival program.

(f) You agree to ensure information provided to us is accurate and that you are the main point of contact, and that you agree to ensure all ensemble lists, names and details are up-to-date and accurate to the best of your knowledge by the close off date of 30 April 2017, 24 hours prior to the final invoice process date of 1 May 2017.

3. PRIVACY

The ASPIRE Privacy Policy Statement can be found on our website at www.aspiremusicfestival.com.au.

4. FESTIVAL PRCING, PAYMENTS & REFUND POLICY

(a) ASPIRE operates a simple 2 step payment process that all schools or customers of ASPIRE must adhere to.

(b) Festival entry fee is $120 per participating student.

(c) A 50% deposit is due on acceptance per participating student with a 12-day payment term. The remaining balance of 50% per participating student invoice is 1 May 2017, with a 12-day payment term.

(d) PAYMENT PROCESS

  • STEP 1: 1ST PAYMENT – 50% NON-REFUNDABLE DEPOSIT PER PARTICIPATING STUDENT. 12 working day payment terms.
  • STEP 2: FINAL BALANCE – final 50% payment per participating student invoiced 1 May 2017. 12 working day payment terms.

(e) Final balance payment is non-refundable.

(f) Prices shown are in Australian dollars and are on a ‘per participating student’ basis.

(g) All prices include GST (if any).

(h) Prices shown are for payment via bank transfer or cheque only.

(i) Our refund policy is 50% deposit is non-refundable. All payments made after the full payment due date are non-refundable.

(j) No cancellation will be accepted after the final payment process date of 1 May 2017. Any person making a cancellation after this date will be liable to make payment for the full amount remaining.

5. RIGHTS TO VARY OUR TERMS AND CONDITIONS

We have the right to amend or revise these terms and conditions as we deem necessary from time to time. These changes are not limited to but may reflect changes to laws and relevant regulatory requirements or changes to our online application processes or business operations.

6. EVENTS OF OUTSIDE OUR CONTROL

ASPIRE or its parent company will not be held responsible for any delay in performance or failure to perform or liable for events outside of our control including and not limited to fire, storm, flood, lock-outs or natural disaster.

7.ARTIST AND VENUE

We reserve the right to add, withdraw or substitute artists, vary any advertised program, change venue and vary audience capacity. No claim for compensation shall be made in the event that the program is varied due to the non-appearance of an advertised artist

8. PHOTOGRAPHY AND FOOTAGE RIGHTS AND CONSENTS

(a) By confirming your booking to attend the ASPIRE International Youth Music Festival, you consent, on behalf of your group, for photographs of participants to be taken during the event and to be included in the filming of any footage documenting the event.

(b) You hereby grant to ASPIRE the irrevocable and unrestricted right to use and publish photographs of you or any members of your group, for publishing in tour brochures, advertising, internet and any other marketing purpose on any medium; to alter the same without restriction; and to copyright the same, save always that ASPIRE hereby undertakes never to utilise any such photographs in a defamatory manner and shall keep such photographs secure throughout the period of their use.

(c) You hereby release ASPIRE or any associated entity and the photographer from all claims and liability relating to the said photographs or footage.

9. LIABILITY

(a) You acknowledge and agree that ASPIRE will not be held liable for the acts, omissions and conduct of any third party including liability in relation to the products, services, actions or failure to act of any venue or for any other person in connection with any performance or in relation to your booking referred to on this site.

(b) Entry to any of our events is at your own risk, and ASPIRE will not be held liable for any loss, injury or damages sustained entering or at the venue, to the extent permitted by the law.

(c) We take no responsibility and will not be liable for any hearing damage or loss sustained in connection with your booking or any event promoted or organised by us. We strongly suggest at your own discretion, that you take the necessary cautionary measures to ensure you address any foreseeable problem or issue that can arise as part of these kinds of musical events, including but not limited to, the wearing of appropriate ear plugs or similar devices, if necessary.

(d) You acknowledge and agree that you will be liable for any loss or damage caused by you or your invitees at the ASPIRE International Youth Music Festival or any other event organised or promoted by us.

10. SEVERABILITY

In the event that any term or condition contained herein is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
